W&M are successful on a Motion for Summary Judgment for an orthopedic spine surgeon on claim by a prisoner plaintiff who contends that the surgery was botched and that the patient fell from the operating table during surgery. Plaintiff’s attempts at an appeal were also unsuccessful.

Jeff Walker of W&M obtains a dismissal on behalf of an orthopedic surgeon accused of negligent hip repair surgery in an elderly female, who walked with a limp post-operatively and required additional revision surgery. Plaintiff dismissed the case with a Motion for Summary Judgment pending, with trial two months away, and just days prior to the expiration of a C.C.P. §998 for cost waiver.

W&M obtain dismissal of wrongful death case for primary care physician accused of failing to timely diagnose and treat symptoms of a gangrenous small intestine. The case was dismissed after multiple attacks on demurrer, and the day before plaintiffs’ response was due to a pending C.C.P. §998 for a cost waiver.

W&M resolve medical malpractice case on eve of trial on behalf of an infectious disease physician for an amount less than defense costs on a claim alleging failure to diagnose and treat septic arthritis in a minor, resulting in a femoral head fracture and orthopedic destruction. In addition to general pain and suffering, plaintiff was seeking economic damages for two future hip surgeries/replacements and future medical care.

In a highly contentious litigation between competing foster care placement programs, W&M are successful on Motion for Summary Judgment on claim of defamation, and obtain dismissals with prejudice on remaining causes of action for Intentional Interference with Prospective Economic Advantage and Unfair Business Practices (B&P 17200).
W&M obtain settlement for client following a successful adversarial bankruptcy proceeding on a business fraud claim, which defendant attempted to discharge via bankruptcy.
